Kaataru Ride – Terms and Conditions

Welcome to Kaataru Ride, a ride-hailing platform operated by Kaataru Ride (“we”, “our”, “us”). These Terms and Conditions (“Terms”) govern your access to and use of our mobile application, website, and services (collectively, the “Platform”).

By registering, accessing, or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use Kaataru Ride.

1. Definitions

  • "App" or "Platform": The Kaataru Ride mobile application and related services.
  • "Driver": An independent contractor who uses the Platform to offer transport services to Riders.
  • "User": A user who requests transportation services through the Platform.
  • "Trip": A transport service arranged through the Platform.
  • "Fare": The total amount a Rider pays for a Trip, including applicable fees, taxes, and surcharges.
  • "Wallet": The in-app payment feature that allows users to pay via mobile money.

2. Eligibility

You must be at least 18 years old to register and use Kaataru Ride. By using the Platform, you confirm that all information you provide is true, accurate, and complete.

3. The Service

Kaataru Ride is a technology platform that connects Riders seeking transportation with independent Drivers offering such services.

Kaataru Ride does not own vehicles and is not a transport company. Drivers operate as independent contractors, not employees or agents of Kaataru Ride.

4. User Accounts

  • You must create an account with a valid phone number and identification.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You agree not to share or transfer your account to another person.
  • Kaataru Ride may suspend or terminate your account if you breach these Terms or engage in fraudulent or unsafe behavior.

5. Payments

  • Fares are displayed in the App before confirming a Trip.
  • Riders may pay by:
    • Mobile Money (via integrated wallet or linked account), or
    • Cash directly to the Driver.
  • For Mobile Money payments, Kaataru Ride facilitates the payment on behalf of the Driver.
  • Drivers agree that Kaataru Ride may deduct service fees or commissions before remitting earnings.
  • All payments are final unless a dispute is raised in accordance with Section 9.

6. Cancellations

  • Riders may cancel a Trip before the Driver arrives without penalty.
  • Repeated cancellations may result in account suspension.
  • Drivers may cancel a Trip if the Rider is unreachable or fails to show up after a reasonable waiting period.

7. Safety and Conduct

All users must:

  • Follow road safety and traffic laws.
  • Treat others with respect and avoid harassment, discrimination, or violence.
  • Not use the Platform for unlawful purposes.
  • Ensure vehicles are roadworthy, insured, and clean (Drivers).

Kaataru Ride reserves the right to suspend users who violate these rules.

8. Ratings and Feedback

Riders and Drivers can rate each other after every Trip. Ratings help maintain service quality. Kaataru Ride may deactivate accounts with consistently poor ratings.

9. Disputes and Refunds

  • If there is a dispute about a Fare, cancellation, or service quality, the Rider or Driver must report the issue through the App within 24 hours.
  • Kaataru Ride will review the case and may, at its discretion, issue partial or full refunds.
  • Decisions made by Kaataru Ride in disputes are final.

10. Liability and Disclaimers

  • Kaataru Ride provides the Platform "as is” and makes no warranties regarding service availability or reliability.
  • Kaataru Ride is not liable for accidents, damages, losses, or injuries arising from Trips.
  • Drivers are solely responsible for their vehicles, passengers, and compliance with laws.
  • To the fullest extent permitted by law, Kaataru Ride’s total liability shall not exceed the amount of service fees paid by you in the past 3 months.

11. Data Protection

Kaataru Ride collects and processes personal data in accordance with the Zambia Data Protection Act (2021).

12. Termination

Kaataru Ride may suspend or terminate your account for violation of these Terms:

  • Fraudulent or unsafe conduct.
  • If required by law enforcement or regulatory authorities.

You may delete your account at any time through the App.

13. Changes to These Terms

Kaataru Ride may update these Terms periodically. Updated versions will be posted in the App and take effect immediately upon publication.

14. Governing Law

These Terms are governed by the laws of the Republic of Zambia. Any disputes shall be resolved in the competent courts of Lusaka.
